1. Provider and scope

These Terms and Conditions apply to orders placed via Lapto.de. The contracting party is Sitrem GmbH, Strausberger Str. 9, 15378 Herzfelde, Germany, Managing Director Taras Popadynets, Local Court of Frankfurt (Oder), HRB 18233 FF, VAT ID DE 335859648.

A consumer is any natural person who enters into a legal transaction predominantly for purposes outside their trade, business or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity acting in the course of its trade, business or profession when concluding the contract.

2. Conclusion of the contract

The presentation of products in the shop does not constitute a legally binding offer but an invitation to place an order. Before submitting the order, you can review and correct your entries. By clicking the final order button, you submit a binding offer to purchase the goods contained in the cart. The contract is concluded when we expressly confirm the order or dispatch the goods.

3. Contract language and contract text

The contract language is German. Your order details and these Terms and Conditions will be provided to you with the order confirmation on a durable medium, in particular by email.

4. Prices and shipping costs

For consumers, the displayed prices include statutory VAT. Additional shipping costs are shown before the order is submitted in the checkout. Net prices may be shown separately for business customers.

5. Payment

The payment methods displayed in the checkout are available. Charging and due dates depend on the selected payment method. For advance payment, the invoice amount becomes due upon receipt of the payment information.

6. Delivery

We deliver to the delivery areas available in the checkout. Delivery time and shipping costs are shown in the respective offer or, at the latest, in the checkout. Partial deliveries are permitted where reasonable for you; they do not result in additional shipping costs.

7. Retention of title

The goods remain our property until full payment has been received. For entrepreneurs, extended retention of title also applies to the extent permitted by law.

8. Right of withdrawal

Consumers have the statutory right of withdrawal. Details are provided in our withdrawal instructions, including the model withdrawal form.

9. Liability for defects and voluntary warranty

Statutory rights relating to defects apply. The condition, signs of use and scope of delivery of a specific used product are described in the product description and product images. A voluntary warranty applies only where expressly stated for the specific product; statutory rights relating to defects remain unaffected.

10. Transport damage

If goods are delivered with obvious transport damage, please report the damage to the carrier as soon as possible and inform us. Failure to do so does not affect consumers’ statutory rights.

11. Liability

We are liable without limitation for intent and gross negligence, for injury to life, limb or health, and under mandatory statutory provisions. In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable damage typical of the contract.

12. Applicable law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of mandatory protections under the law of their country of habitual residence. For merchants and legal entities under public law, the registered office of Sitrem GmbH is the place of jurisdiction where legally permissible.
